Terms and Conditions (T&C)

1. General Provisions and Scope

These Terms and Conditions (T&C) apply to all business transactions between LUXEN GmbH (hereinafter referred to as “the Company”) and the customer (hereinafter referred to as “Customer”) regarding products sold under the MANZ label. They apply to all offers, agreements, and contracts between the Company and the Customer.

By completing the order or submitting the registration form, the Customer agrees to these T&C in full. These T&C also apply to future business relations, even if not explicitly agreed upon again.

2. Payment Terms

The prices listed on the website are in EUR and include VAT unless otherwise stated. The price at the time of the order is binding. The Customer agrees to pay the full amount for the product(s) ordered, including shipping fees.

Payments are due immediately after the Customer receives the invoice. Payment is only accepted through the payment methods available on the website (e.g., credit card, PayPal).

3. Contract Subject

The subject of the contract is the products and services specified in the order. The contract is concluded when the Customer receives a confirmation email from the Company after submitting the order.

All offers on the website are non-binding. The Company reserves the right to change product descriptions, prices, and availability without prior notice.

4. Delivery Terms

Delivery times are estimated and not guaranteed. The Company will make reasonable efforts to ship the products within the stated timeframe. Delivery is subject to product availability and payment confirmation.

The Customer must ensure that the shipping address provided is correct. The Company is not liable for delays caused by incorrect or incomplete addresses.

5. Right of Withdrawal and Returns

The Customer has the right to withdraw from the purchase contract within 14 days from the date of receiving the goods. To exercise the right of withdrawal, the Customer must notify the Company in writing or via email.

Items must be returned in their original condition with all tags and packaging intact. Returns will be at the Customer’s expense unless the product is faulty or damaged upon arrival. Refunds will be issued after the returned items have been received and inspected.

6. Warranty and Liability

The Company offers a warranty on all products, which covers any defects that occur within a reasonable time after purchase. The Company is responsible for replacing or repairing any defective products.

The Company is not liable for damages that arise from improper use, alterations, or accidents caused by the Customer.

7. Privacy and Data Protection

The Customer’s personal data (name, address, email address, phone number) will be treated with confidentiality and processed in accordance with applicable data protection laws. The Company will use personal data for order fulfillment and, with the Customer’s consent, for marketing purposes.

The Customer may withdraw consent for marketing communications at any time.

8. Intellectual Property

All content on the website, including text, images, logos, and product designs, is the property of LUXEN GmbH and MANZ or its licensors and is protected by copyright law. The Customer may not reproduce, modify, or distribute any content without prior written consent from the Company.

9. Customer’s Obligations

The Customer agrees to provide accurate and complete information when placing an order. It is the Customer’s responsibility to ensure that the items ordered meet their requirements before placing the order.

The Customer is also responsible for paying any customs duties or taxes that may apply upon delivery.

10. Governing Law and Jurisdiction

These T&C are governed by Austrian law. In the event of a dispute, the exclusive place of jurisdiction will be the court located at the Company’s business location. However, the Company reserves the right to bring proceedings at the Customer’s place of residence or business.

11. Final Provisions

If any provision of these T&C is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be replaced by a valid provision that reflects the original intent as closely as possible.

Any amendments or additions to these T&C must be made in writing.
